Mr Thomas Freeman and Electricity Supply Board (CEI/16/0010)
The Commissioner found that, while the AIE request was made to the ESB, the ESB did not process it in accordance with the AIE Regulations. Accordingly, the Commissioner annulled the ESB's deemed refusal. The ESB should now process the request in accordance with the AIE Regulations.

In accordance with article 12(5) of the AIE Regulations, the Commissioner reviewed the decision of ESB and found that it was justified in refusing the request under article 9(2)(a) of the Regulations. He affirmed the decision of ESB accordingly.

The Commissioner found that the information is environmental information, and, with the exception of certain information which the Commissioner found to be commercially sensitive, refusal was not justified. Accordingly, the Commissioner varied ESBN’s decision and required ESBN to make certain information available to the appellant.
